Recently, a U.S. federal appeals court upheld a law requiring TikTok to sever ties with its Chinese parent company, ByteDance, or face a ban in January 2025. This news led many to believe TikTok was doomed, but the reality may be different. TikTok's fate still has a chance; let's analyze the story behind it.

Background: The clash between law and national security

The U.S. government believes TikTok may threaten national security, including by collecting user data or manipulating public opinion. However, TikTok has repeatedly denied these allegations and challenged the government's evidence. This court ruling holds that the law is designed to prevent potential risks, not to directly suppress content, and therefore does not violate the First Amendment to the U.S. Constitution.

Nevertheless, TikTok has stated that it will appeal to the Supreme Court. This lawsuit is not only about TikTok's survival, but also involves a complex struggle between national security and freedom of speech.

Where does TikTok's confidence come from?

TikTok has assembled a seasoned lawyer, Andrew Pincus, for this battle; he has handled over 30 U.S. Supreme Court cases. Clearly, TikTok planned to take the case to the Supreme Court. The composition of the Supreme Court may well be a key factor in this dispute.

Currently, the U.S. Supreme Court is predominantly composed of conservative justices (6-3), whose political ideologies lean towards "small government" and "weak regulation." Furthermore, three of the conservative justices were appointed by Trump, and Jeff Yass, one of Trump's major donors, happens to be a significant investor in TikTok. This delicate political and economic relationship increases TikTok's chances of winning.

Why is TikTok so important?

TikTok is more than just a short video platform; it's an integral part of users' lives worldwide. In the US alone, it boasts over 170 million users, creating countless jobs and a thriving creator economy. A ban would not only impact users but also severely damage small and medium-sized enterprises and content creators.

Furthermore, TikTok is also involved in the global issue of regulating technology companies. How exactly do we balance national security and technological innovation?
